Onslow County murder suspect appears before judge for second time this week

ONSLOW COUNTY, N.C. (WITN) - For the second time this week an Onslow County shooting suspect made his first court appearance.

Shawn Sturdivant appeared via video conference this morning on a murder charge.

Deputies say Joshua Lindauer died Tuesday night at New Hanover Regional Medical Center. The former Marine was shot in the head with a .22 caliber bolt-action rifle Monday afternoon at a home on March Lane in Midway Park.

Sturdivant was originally charged with assault with a deadly weapon inflicting serious injury and went before a judge Tuesday morning.

The charge against the man was upgraded to murder and that necessitated the second first appearance.

The victim's wife says Lindauer served ten years in the Marine Corps, and had two combat deployments to Iraq and one to Afghanistan.

His family has set up a GoFundMe account to help pay medical and funeral expenses.

Sturdivant remains in jail without bond.

Charges have been upgraded against an Onlsow County man now that the man he is accused of shooting has died.

The Onlsow County Medical Examiner's Office says an autopsy is planned today for Joshua Lindauer.

Deputies say Lindauer was shot in the head with a .22 caliber bolt-action rifle Monday afternoon at a home on March Lane in Midway Park. He had been at New Hanover Regional Medical Center with critical injuries from the shooting.

Major Chris Thomas says Lindauer passed away last night.

Shawn Sturdivant had been charged in the shooting and appeared before a judge Tuesday on the assault with a deadly weapon inflicting serious injury charge.

Wednesday afternoon that charge was upgraded to an open count of murder.

Thomas says Sturdivant is being held without bond and is expected to go before a judge on Thursday for the new murder charge..

Investigators have made an arrest in a shooting that happened Monday in Onslow County.

Shawn Sturdivant is facing several charges including felony assault with deadly weapon inflicting serious injury, felony of firearm by felon, simple possession of marijuana and possession of drug paraphernalia.

Arrest warrants show the victim, Joshua Lindauer, was shot with a .22 caliber bolt-action rifle and was taken to the Onslow Memorial Hospital.

Major Chris Thomas says the shooting happened shortly after 4:00 p.m. Monday on March Lane in Midway Park. He said the victim was shot in the head and is now at New Hanover Regional Medical Center with life-threatening injuries.

Thomas says the shooting was the result of an argument between the two men.

Sturdivant was previously convicted of a felony possession with intent to manufacture sell or deliver cocaine in 2007 and was sentenced to five years probation in 2008.

He is currently being held on a $150,000 bond.

Investigators are looking into a shooting that happened Monday night in Onslow County.

Maj. Chris Thomas, with the Onslow County Sheriff's Office, says the shooting happened around 4:45 p.m. on March Lane off Piney Green Road.

He says the victim was taken to the hospital.

No word yet about the condition of the victim, if investigators have any suspects or if anyone has been taken into custody. Thomas says they are not releasing any more details at this time.
